SB199 Passes in the 2025 Utah Legislative Session

SB199 Guardianship Statutes Bill sponsored by Senator Stratton passed at the Utah Legislature in March 2025!


Under a Utah law passed three years ago, 75-5-301.5, an individual with severe intellectual disabilities could marry, associate with harmful people, cohabitate, drive, drink, vape, etc. all without their full legal guardian's permission or even knowledge.  As background, when a child with these disabilities turns 18, parents must go through an expensive court process to be named as guardians to be able to protect their child. 

 

SB199 inserts the parents/guardian back into the equation and requires them to give permission for their adult child to do these things.  It also makes the guardianship process easier (prefers a remote hearing, makes it so siblings don’t have to file an annual report, etc) and makes the guardianship process less expensive.
